in better news, two prominent lawyers who argued on opposite sides of bush v. gore have filed a federal suit challenging prop 8 and asking for a injunction on the ban on gay marriage in the meantime. i'm not much of a legal scholar, so i don't know what the chances are.

Still, filing a federal lawsuit at this point "sounds like a silly and rash act," said UC Davis law professor John Oakley, an expert on the federal court system. "There is no evidence that the Court is near that point (to approve same-sex marriage.)"
